Welcome to AI TOP (https://aitop.space), operated by TOO “AVA NEXUS” (“we,” “our,” or “us”).

By accessing or using AI TOP — including our website, products, and services — you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

1. What Is AI TOP?

AI TOP is a portfolio of AI-powered products and services for monitoring, promotion, and automation. It includes, among others:

• Threads Engine — a tool for monitoring brand mentions and topics on Threads and for generating replies and content;
• AI Search Monitoring — measurement of brand or app visibility in AI-chat answers (ChatGPT, Gemini, Perplexity, Google AI Overviews) and recommendations for improving it;
• Services — ASO & GEO consulting and promotion, business-process automation, and AI agent development, delivered on a custom basis.

The specific scope, features, and deliverables of each product or service are described on its page or agreed with you directly. We may add, change, or retire products over time.

2. Who Can Use AI TOP?

The Service is intended for businesses and professionals. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use it. By using the Service on behalf of an organization, you confirm you are authorized to bind that organization to these Terms.

3. Your Responsibilities

You are responsible for the accuracy and legality of the information you provide and the targets you ask us to monitor or analyze. You agree not to use the Service to:

• violate any applicable law or regulation;
• infringe the rights, including intellectual property rights, of any third party;
• attempt to compromise the security or integrity of the Service or of any third-party platform;
• pursue fraudulent, abusive, or malicious purposes.

We reserve the right to suspend or terminate access if the Service is used in any of these ways. You agree to indemnify and hold TOO “AVA NEXUS” harmless from any claims arising out of your use of the Service or the data and instructions you provide.

4. Billing, Subscriptions, and Refunds

Some products are offered as one-time purchases and some as subscriptions, as described on the relevant product page. Payments are processed by third-party providers, which may include Tribute, Robokassa, and YuKassa, depending on your region and the product.

• Prices, billing periods, and what is included are shown on the product page or agreed with you before purchase.
• Subscriptions renew automatically for the same period unless cancelled before the next billing cycle.
• You can request cancellation through the contact methods provided or through the payment provider.
• Refund terms: FILL IN. State your actual refund policy here clearly (the conditions and timeframe under which a refund is or is not available). Required by payment-provider moderation before connecting payments.
• We do not store full payment-card data; payment providers handle that securely under their own terms.

5. No Guarantees

Our monitoring products and recommendations are measurement and advisory tools. We make no guarantee of specific outcomes — including appearance in AI-chat answers, search or store rankings, traffic, leads, or revenue. Results depend on many factors outside our control. We work only with reproducible signals and label the realism of our recommendations honestly; we do not promise the impossible.

6. Service Availability and Changes

We may change, suspend, or discontinue any part of the Service — including features, products, and pricing — at any time. We rely on third-party platforms and APIs that may change or become unavailable, which can affect functionality. Continued use after changes take effect means you accept the updated Terms.

7. Termination

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms or use the Service in a way that harms us, other users, third parties, or our reputation.

8. Intellectual Property

All content, technology, methodology, design, and branding of AI TOP are owned by TOO “AVA NEXUS” or its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.

9. Limitation of Liability

To the fullest extent permitted by law, TOO “AVA NEXUS” shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us for the relevant product or service in the preceding three (3) months.

10. Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan. Any disputes shall be subject to the competent courts at the location of TOO “AVA NEXUS”, unless mandatory consumer-protection law provides otherwise.
